The following Terms of Purchase contain the entire terms of the sale of goods by Ammo Importers, LLC (“Ammo Importers”) to the respective individual purchaser accepting the agreement below (“Buyer”). The Buyer is required to and hereby does confirm to the following Terms of Purchase.
You must agree to these terms conditions before your order will be processed.
1. PURCHASE AND SALE.
Subject to the terms and conditions of the Terms of Purchase, Ammo Importers agrees to sell and deliver possession to the Buyer, and the Buyer agrees to pay for and accept from Ammo Importers, the Goods listed in purchase order attached hereto, in such amounts and at such prices as identified.
2. BUYER’S REPRESENTATIONS AND WARRANTIES.
It is the Buyer’s obligation to know and fully adhere to all federal, state, and local laws and ordinances regarding offers to sell, transfer, or purchase of ammunition.
Buyer is not requesting shipment of goods to any location that is prohibited by federal, state, or local law or ordinance. Ammo Importers does not ship items outside of the lower forty-eight states of the United States.
Buyer represents that he or she is: (a) not prohibited by law, ordinance, or court order from purchasing or possessing ammunition; (b) over twenty-one years of age; (c) not adjudicated with a mental disability; and (d) willing, ready, and able to comply with all federal, state, and local laws and ordinances with respect to the purchase and possession of ammunition.
Specifically
All ammunition buyers must:
– Be at least 21 years of age
– Never have been convicted of a felony or crime punishable by imprisonment for a term exceeding one year
– Never been adjudicated as mentally defective or been committed to a mental institution
– Never have been a fugitive from justice, an unlawful user of any controlled substance
– Have not been dishonorably discharged from the Armed Forces
– Never have renounced his or her US citizenship
– Have not been convicted of a misdemeanor crime of domestic violence;
– Never have been subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child
Buyer understands that discharging or otherwise handling ammunition, firearms, and firearm components requires expertise and care.
3. AMMO IMPORTERS’ REPRESENTATIONS AND WARRANTIES.
Ammo Importers does not warrant that the goods are merchantable or fit for any particular purpose and this sale is made “AS IS.” There are no express or implied warranties made by the Ammo Importers, except as expressly stated in the Terms of Purchase. Ammo Importers specifically denies all other representations or warranty, express or implied, of fitness or merchantability concerning the goods or their fitness for any particular use.
We comply with ALL local, state, and federal laws. It is your responsibility to be aware of and comply with any laws affecting your purchase.
4. DELIVERY, CANCELLATION, AND RETURN POLICY
Buyer understands that by accepting the Terms of Purchase and completing the order, Ammo Importers’ order system automatically submits the order for packaging and shipping. As a result, an order cannot be cancelled. All orders for ammunition are shipped requiring an adult signature.
We do not ship to APO/FPO addresses.
We do not ship to P.O. Boxes. A physical address is required.
We do not ship outside of the the lower 48 United States.
The following areas have special restrictions:
– Alaska, California, Hawaii and Massachusetts: We do not ship ammunition to these states.
– Illinois: Must have current copy of FOID card and State Photo Identification, we do not ship ammunition to the City of Chicago.
– New Jersey: Firearms/Ammunition identification card must accompany ammunition orders for first time.
– New York: We do not ship ammunition to New York City
– Washington DC and US Territories of Guam and Puerto Rico: No Sales of ammunition.

Subject to all applicable federal, state, and local laws and ordinances, Ammo Importers agrees to ship all orders in a timely fashion. Once the shipment is entrusted with a common carrier, Ammo Importers does not have control or responsibility over the shipment.
Due to safety and security issues Ammo Importers does not accept returns of ammunition. In exceptional cases please contact us at support@ammoimporters.com or call +1(619)630-7454. Ammo Importers in its sole discretion may either replace the damaged or defective goods or issue a refund of the purchase price.
5. INDEMNIFICATION AND RELEASE OF LIABILITY.
To the fullest extent permissible under the law, the Buyer shall at all times indemnify, defend and hold harmless Ammo Importers, and all its members, employees, agents, and representatives, against all claims, actions, damages, losses, liabilities, and expenses, including reasonable outside attorneys’ fees and costs, arising out of or caused by any breach of any of the representations, undertakings, or agreements made by the Buyer under or pursuant to this Agreement.
By agreeing to the Terms of Purchase, Buyer understands and agrees that Buyer is releasing Ammo Importers from any and all liability arising from or related to the goods purchased to include but not limited to the use of the goods, the storage of the goods, and any further distribution of the goods by the Buyer or any third-party.
6. BINDING ARBITRATION.
Any controversy or claim arising out of or relating to the Terms of Purchase, or the breach, termination, or invalidity of the Terms of Purchase, or the underlying transaction shall be settled by arbitration in accordance with JAMS Streamlined Arbitration Rules & Procedures. The arbitrator(s) shall be bound by the Terms of Purchase and shall interpret the Terms of Purchase in accordance with the applicable laws of the United States and State of California. The Buyer agrees that the forum of the arbitration will be San Diego, California. Any award, order, or judgment made pursuant to such arbitration shall be deemed final and shall be entered and enforced in any court of competent jurisdiction.
7. GOVERNING LAW.
The Terms of Purchase and underlying transaction shall be governed by the laws of the State of California. In the event that litigation results from or arises out of the Terms of Purchase or underlying transaction, the parties agree to reimburse the prevailing party’s reasonable attorneys’ fees, court costs, and all other expenses, whether or not taxable by the court as costs, in addition to any other relief to which the prevailing party may be entitled.
8. ENTIRE AGREEMENT.
The Terms of Purchase constitutes the final, complete, and exclusive statement of the agreement of the parties with respect to the subject matter hereof, and supersedes any and all other prior and contemporaneous contracts and understandings, both written and oral, between the parties.
BY ACCEPTING THE TERMS OF PURCHASE BUYER ACKNOWLEDGES HE OR SHE HAS READ THE FOREGOING TERMS OF PURCHASE AND FULLY UNDERSTANDS AND ACCEPTS ITS TERMS.
